Personal data protection matters a lot for Raben. Therefore, all your data is processed in accordance with the relevant legal provisions (GDPR and the Swiss Federal Act on Data Protection (‘FADP’) as well as all other applicable data protection regulations (hereinafter jointly referred to as ‘data protection regulations’). Using the contact form on our website you can contact us or send some comments, which will be forwarded to the applicable specialist department. 

With the contact form your name, email address, company name, subject and message content are collected and then used for re-contacting you and maintaining customer relations. This data is transferred to nobody without your explicit consent, unless it is necessary for contract performance or any pre-contractual activities. 

3. Transfer of data to third parties
Any personal data shall only be transferred if this is legally permitted or required to meet contractual or legal obligations.

Purposes of processing, legal grounds for processing and categories of personal data processing 

Personal data of customers or potential customers will be processed for the following purposes:    

  • performance of the concluded agreement or for action to be taken to conclude it (Article 6(1)(b) of the GDPR);
  • meeting the legal obligations incumbent on the controller, including in particular under the tax and accounting regulations (Article 6(1)(c) of the GDPR and the equivalent provisions of the FADP);
  • pursuit of the legitimate interests of the controller which include: promoting the activity and presentation of the controller’s offer, the assertion of or defence against possible claims (by either party), as well as the conduct of activities of an administrative and technical nature (e.g. the provision of cyber security or legal services for processes within the organisation) (Article 6(1)(f) of the GDPR and the equivalent provisions of the FADP). 

 

Personal data of representatives of legal entities and contact persons designated by customers or potential customers (in the form of name, surname, e-mail address, position, place of work, telephone number) will be processed for the following purposes:  

  • pursuit of the legitimate interests of the controller which include: taking action to conclude a contract with the entity the individual represents, its conclusion and performance, including ongoing communication during the course of the contract, promoting the activity and presentation of the controller’s offer, the assertion of or defence against possible claims (by either party), as well as carrying out activities of an administrative and technical nature (e.g. ensuring cyber security or legal service of processes within the organisation) (Article 6(1)(f) of the GDPR and the equivalent provisions of the FADP);
  • meeting the legal obligations incumbent on the controller, including in particular under the tax and accounting regulations (Article 6(1)(c) of the GDPR and the equivalent provisions of the FADP). 

Notwithstanding the above, in accordance with generally applicable legislation separate from the GDPR or FADP, your consent is required for us to carry out direct marketing activities via communication channels such as email or telephone.  You may revoke the consent you have granted at any time, however this does not affect the lawfulness of actions taken on the basis of this consent prior to its revocation. 

 Period of data storage 

The period of processing personal data depends on the purpose of the processing indicated above. 

We keep the data obtained in connection with contract conclusion and performance for the time when possible claims can be lodged (or it is possible to defend against them), or for the time resulting from applicable regulations. With regard to the processing of your data for the purpose of promoting the business activity and presenting the offer of the controller, personal data is processed until the time of revocation of the consent granted under separate regulations or until you file an objection to the processing of your personal data. With regard to the processing of personal data for the purpose of carrying out activities of an administrative-technical nature, data will be processed as long as we have a legal basis for processing for other purposes.

Personal data may also be transferred to data processors established outside Switzerland and the European Economic Area (EEA) 

Countries outside Switzerland and the EEA may not offer the same level of personal data protection as Switzerland and the EEA countries. Before personal data are transferred outside Switzerland and the EEA, Raben Sieber AG will make every effort to ensure that such transfer does not lead to a reduction in the level of protection guaranteed under the regulations in force in Switzerland and the EEA countries. If personal data are transferred outside Switzerland and the EEA, the transfer will be based on an adequacy decision or on the basis of standard data protection contractual clauses adopted by the Swiss Authorities and the European Commission. You may also request additional information with regard to the transfer of the data outside Switzerland and the EEA (including the copy of appropriate safeguards) by contacting us as described in point 2 above.
